New York Cell Phone Ticket Penalties

Cell phone tickets in New York fall under 2 categories according to the NYS Vehicle & Traffic Laws:

  • Communicating on a cell phone while operating a motor vehicle (Sec. 1225-C).
  • Texting (transmitting data) while opearting a motor vehicle (Sec 1225-D).
Points Max Fine Surcharge
1st Offense 5 pts $50 - $150 $88-$93
2nd Offense (within 18 months) 5 pts $50 - $200 $88-$93
3rd+ Offense (within 18 months) 5 pts $50 - $400 $88-$93
Effective July 26, 2013.

*Drivers who receive 6 or more points are subject to additional fines known as Driver Responsibility Assessment Fees (DRA)

Once a driver has received 6 points or more on their record they are subject to the DRA. The fine for the DRA is $100 and must be paid every year for 3 years. If a driver has received more than 6 points, they are fined an additional $25 a year for 3 years for every point over 6.

**Outside NYC Your Driver's License will be automatically suspended after 11 points and inside NYC it is in the discretion of the presiding ALJ (Administrative Law Judge). Many judges will suspend the license for a 3rd cell phone violation.
